Privacy Policy

This Privacy Policy explains how Chert Technologies, Inc. (“Chert,” “we,” “us,” or “our”) collects, uses, and shares personal information in connection with our website at trychert.com and our iMessage infrastructure, APIs, dashboard, webhooks, automation tools, and related messaging services (collectively, the “Services”).

Chert provides infrastructure that enables businesses and developers to send, receive, route, automate, and observe business messaging, primarily over iMessage and related channels. This policy applies both to (a) customers, developers, and website visitors who interact with us directly, and (b) message recipients and end users whose information is processed through the Services on behalf of a Chert customer.

1.Information We Collect

  • Information you provide directly.When you contact us, book a call, create an account, request support, or correspond with us, we collect information such as your name, business email, phone number, company, role, billing details, and the contents of your messages.
  • Customer-provided data.Our customers upload, sync, transmit, receive, or otherwise provide information through the Services, including recipient identifiers, message content, contact metadata, integration data, webhook payloads, phone-line configuration, and other business-context attributes. Customers represent that they have a lawful basis to share this information with us for processing.
  • Recipient and conversation data.When messages are sent, received, routed, or automated through the Services, we collect and store message content, delivery and response status, timestamps, sender and recipient identifiers, attachments or media metadata where applicable, and any information a recipient chooses to share in reply.
  • Integration and operational data.To operate the Services, we collect API usage, request and response logs, webhook delivery attempts, error reports, authentication events, connected account metadata, integration configuration, and support diagnostics.
  • Usage and device data.When you visit our website, we automatically collect IP address, browser type, device identifiers, pages viewed, referring URLs, and similar technical data via cookies and analytics tools.

2.How We Use Information

  • To provide, operate, secure, and improve the Services;
  • To send, receive, route, automate, and observe messages and related events on behalf of our customers;
  • To provide dashboards, webhooks, delivery status, support, and integrations;
  • To provide optional AI-assisted drafting, routing, classification, enrichment, or automation features when enabled or requested by a customer;
  • To communicate with you about the Services, respond to inquiries, and send product updates you have opted into;
  • To comply with applicable laws (including messaging, anti-spam, and consumer protection laws), enforce our agreements, and protect the rights, property, and safety of Chert, our customers, and others.

3.AI & Automated Messaging Disclosure

Certain Services may use artificial intelligence to draft, classify, route, summarize, enrich, or automate messages and operational workflows on behalf of our customers. Conversations and related operational data may be reviewed by Chert personnel for quality, safety, support, and compliance purposes. If you are a recipient of a Chert-powered message and would like to confirm whether you are speaking with an automated system or a human, you may ask, and we will provide an honest response where Chert controls that conversation experience.

4.How We Share Information

We do not sell personal information. We share information only in the following circumstances:

  • With our customers. Conversation data and recipient responses are shared with the Chert customer on whose behalf messages are sent, received, routed, or processed.
  • With service providers (sub-processors). We use vetted third parties to host infrastructure, deliver messages, operate phone-line or account connectivity, run AI models when applicable, send email, process payments, monitor errors, and analyze usage. These providers are contractually limited to processing data on our instructions. Categories include: cloud hosting and storage, large language model providers, messaging and telephony providers, analytics, payments, security, and customer support tools.
  • For legal reasons. We may disclose information when required by law, subpoena, or legal process, or when we believe in good faith that disclosure is necessary to protect rights, safety, or property.
  • In a corporate transaction. If Chert is involved in a merger, acquisition, financing, or sale of assets, information may be transferred subject to standard confidentiality protections.
  • With your consent or at your direction.

5.Your Choices & Rights

Opt out of messaging. You can stop receiving messages from a Chert-powered campaign at any time by replying STOP (or any similar opt-out term) to the conversation, or by emailing contact@trychert.com with the phone number or email address you would like removed. We honor opt-outs for the channel and identifier specified where Chert controls or can reasonably apply the suppression.

Access, correction, deletion, and portability. Subject to applicable law, you may request that we access, correct, delete, or provide a copy of personal information we hold about you, or that we restrict or object to certain processing. To exercise these rights, email contact@trychert.com. For recipient or customer-controlled data held on behalf of a Chert customer, we will generally route the request to the relevant customer (the data controller) and assist them in responding.

California residents (CCPA/CPRA). California residents have the right to know what personal information we collect, the right to delete it, the right to correct inaccuracies, the right to opt out of “sale” or “sharing” (we do not sell or share personal information as those terms are defined under the CCPA), and the right to be free from discrimination for exercising these rights.

EEA, UK, and Swiss residents (GDPR). If you are located in the European Economic Area, United Kingdom, or Switzerland, our legal bases for processing personal data are: performance of a contract, our legitimate interests in operating and improving the Services and conducting B2B outreach, compliance with legal obligations, and your consent where required. You have the right to lodge a complaint with your local supervisory authority.

6.Cookies & Analytics

We use cookies and similar technologies on our website to remember preferences, measure traffic, and understand how the site is used. You can control cookies through your browser settings; disabling cookies may limit some features.

7.Data Security

We maintain administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit, access controls, and vendor due diligence. No system is 100% secure, and we cannot guarantee absolute security.

8.Data Retention

We retain personal information for as long as necessary to provide the Services, comply with our legal obligations, resolve disputes, and enforce our agreements. Customer-controlled data is retained according to the customer’s instructions and the applicable customer agreement. We delete or anonymize data when retention is no longer necessary for these purposes.

9.International Data Transfers

Chert is based in the United States. If you access the Services from outside the United States, your information will be transferred to, stored, and processed in the United States and other jurisdictions in which our service providers operate. Where required, we rely on appropriate safeguards such as Standard Contractual Clauses for cross-border transfers.

10.Children

The Services are intended for businesses and are not directed to children under 16. We do not knowingly collect personal information from children. If you believe a child has provided us personal information, please contact us so we can delete it.

11.Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will revise the “Last updated” date above and, for material changes, take additional steps to notify you. Your continued use of the Services after the effective date constitutes acceptance of the updated policy.
